The SAP conducts a follow-up evaluation after prescribed education or treatment, reviews program information, meets the employee again and decides whether successful compliance has been demonstrated. Only then can an employer choose to arrange a return-to-duty test.
The employee should complete the education or treatment milestones identified by the SAP and follow the SAP’s instructions for scheduling. DOT guidance prefers the same SAP to conduct both the initial and follow-up evaluations when practical, but another qualified SAP can conduct the follow-up evaluation in appropriate circumstances. That is different from shopping for a second opinion because the employee dislikes the first SAP’s recommendation.
