A SAP return-to-duty evaluation is the second clinical meeting in the DOT process. It occurs after the employee has followed the Substance Abuse Professional’s education or treatment recommendation. The SAP reviews information from the program, meets with the employee again and decides whether the employee has demonstrated successful compliance. Only then can an employer choose to arrange a return-to-duty test.
When to book the follow-up SAP evaluation
The employee should complete the education or treatment milestones identified by the original SAP and follow that SAP’s instructions for scheduling. Part 40 requires the original SAP to conduct the follow-up evaluation. A replacement is appropriate only in exceptional circumstances allowed by the rule, not because the employee wants a different recommendation or faster result.
Before the appointment, the SAP should be able to obtain appropriate documentation from the education or treatment professional. A receipt or self-reported completion may not give the SAP enough information. The employee should confirm that any required release has been signed and that the provider knows where to send records.
What happens at a return-to-duty evaluation?
- Program documentation is reviewed. The SAP considers attendance, participation and information from the referred provider.
- The employee is interviewed again. The session must meet the same in-person or compliant real-time video standard as the initial evaluation.
- Successful compliance is assessed. Only the SAP makes this clinical decision, and it is not purchased with the appointment fee.
- A report goes to the DER. The SAP states whether the employee demonstrated successful compliance and includes the required information.
- A follow-up testing plan is set. When compliance is successful, the SAP provides the employer with the testing directions required by Part 40.
Successful compliance does not mean treatment is over
A SAP may determine that an employee has successfully complied even when continuing care, aftercare or support is recommended. The employer may include those ongoing recommendations in a lawful return-to-duty agreement. Continuing services do not replace follow-up tests, and follow-up tests do not replace the recommended services.

What the employer must do after a successful evaluation
The employer, not the SAP or driver, orders the return-to-duty test. The employee must have a negative drug result and, when applicable, an alcohol concentration below 0.02 before resuming safety-sensitive functions. DOT return-to-duty and follow-up drug tests are conducted under direct observation. For an FMCSA-regulated driver, the driver designates the SAP in the Clearinghouse, the SAP reports the initial-evaluation and successful-compliance milestones, and the employer or its designated C/TPA reports the qualifying return-to-duty result.
After return to covered work, the employer must carry out the SAP’s follow-up plan. Tests must be unannounced, have no discernible pattern and use the follow-up reason. A random test cannot be relabeled or counted as a follow-up test. A cancelled test does not satisfy the plan. The plan follows the employee through breaks in service and changes of DOT employer. A subsequent employer must obtain the applicable prior-employer information and continue the remaining plan rather than starting the clock again.
How to compare SAP return-to-duty providers
- Does the provider verify the original SAP relationship before accepting the case?
- Will it coordinate directly with the education or treatment resource?
- How quickly are complete reports delivered securely to the DER?
- Can it explain the boundary between the SAP determination, employer decision and laboratory result?
- Does it support compliant video evaluations in the employee’s state?
- Will it provide clear follow-up testing instructions without disclosing the schedule to the employee?
- For CDL cases, does it complete the SAP’s required Clearinghouse reporting promptly?
Red flags that can stall the process
Be cautious when a provider advertises an automatic pass, says a course alone completes the DOT process, offers a letter without a clinical interview, or sends the employee to order a personal return-to-duty test. A provider should also never disclose future follow-up testing dates to the employee. The employee must have returned to a DOT safety-sensitive position and remain subject to the follow-up plan, but the collection need not occur while the person is literally performing a safety-sensitive function at that moment.
Employers should not treat a driver’s Clearinghouse status, a course certificate or a negative non-DOT test as a substitute for the SAP report and employer-arranged test. Each item answers a different question. Administrative coordinators can organize records and appointments, but only the SAP can decide successful compliance and prescribe the follow-up testing plan.
Prepare for the appointment
The employee should have the original SAP’s instructions, program contact details, completion information and any continuing-care plan. The employer should make sure the SAP has the correct DER contact. For a remote evaluation, choose a private location with reliable two-way video and do not attempt to join from a moving vehicle.
