One-truck owners in Hialeah still need a C/TPA

About 5,440 of the roughly 6,920 carrier records with a Hialeah address show a single power unit. For an owner-operator who employs himself or herself as a CDL driver subject to Part 382, that creates both employer and driver responsibilities.

Owner-operators must designate a C/TPA in the Clearinghouse to handle the employer reporting functions that require a C/TPA. A designated C/TPA can also conduct queries on the carrier’s behalf. The carrier still needs its own Clearinghouse employer account and query plan.

Intrastate operations still need attention

About 5,750 of the Hialeah carrier records are intrastate-only. That should not be treated as an automatic exemption from drug and alcohol requirements. Florida generally applies 49 CFR Part 382 to covered intrastate commercial motor vehicle operations, subject to the state’s own statutory provisions and exceptions.

Hiring a CDL driver

For a driver who will perform safety-sensitive functions subject to Part 382:

• Complete a full pre-employment Clearinghouse query before the driver begins that work. The driver provides specific electronic consent through the Clearinghouse.
• Make sure your employer account has a query plan available before the query is needed. Employers purchase their own query plans.
• Query each covered driver at least once during each 12-month period. The annual requirement can be satisfied with a limited query when the required general consent is in place.
• If a limited query shows that information exists in the driver’s Clearinghouse record, complete the required full query within 24 hours.
• Keep the driver’s written or electronic limited-query consent for three years. The Clearinghouse maintains the employer’s query history.

If the Clearinghouse shows that a driver is prohibited, the driver cannot perform a safety-sensitive function. The return-to-duty process includes evaluation by a qualified SAP, completion of the SAP’s prescribed education or treatment, a follow-up SAP evaluation and a negative directly observed return-to-duty test. The driver is then subject to the SAP’s follow-up testing plan. What to have ready for a Clearinghouse provider

Have your USDOT information, driver list, hire dates, current Clearinghouse status and drug and alcohol testing program information ready. Do not give a third party your Clearinghouse password. A C/TPA should use its own account after you designate it to work for your company.
