DOT Drug Test Refusal: Decisions, Records and SAP Support

Separate the collection facts from the final decision

49 CFR 40.191 describes conduct that can constitute a DOT drug-test refusal. Examples include not remaining until collection is complete, failing to cooperate with required instructions and missing certain directed tests. Specific exceptions exist, including pre-employment situations. A refusal is not simply any unsuccessful collection.

For collection conduct, the collector records the event and promptly informs the DER. The employer has the non-delegable responsibility for the conduct-based refusal decision. The MRO handles findings within the MRO’s remit, including verified adulteration or substitution and medical determinations after an insufficient specimen.

An accidental event still needs a documented review

A driver might describe leaving as a misunderstanding, a missed appointment as a scheduling problem or an insufficient sample as embarrassment. Those explanations need to be assessed against the actual rule and records. They are not automatic exceptions, but neither should every collection problem be labeled a refusal without the applicable review.

Keep the collection form, timestamps, directions given, communications and the decision-maker’s explanation. Avoid circulating unnecessary medical details to dispatch or other staff. If the issue was insufficient urine, check the required shy-bladder procedure before treating the first failed attempt as the final finding.

What to do when a Clearinghouse entry is disputed

For FMCSA-regulated drivers, the reporting party and nature of the information determine the appropriate correction or petition route. Keep the relevant records and use official Clearinghouse support where needed. Filing a challenge does not itself remove a prohibited status or authorize driving.

A SAP cannot delete a violation, change the laboratory result or override the employer’s refusal determination. Evaluate a reporting dispute separately from arrangements for a required SAP evaluation.

When a refusal requires SAP and return-to-duty work

A refusal that stands is a DOT violation under 49 CFR 40.285. The employee cannot resume DOT safety-sensitive duties until the applicable SAP and return-to-duty requirements have been completed. The SAP evaluates the employee, prescribes education or treatment, and later assesses successful compliance.

For an FMCSA-regulated driver with a current or prospective employer subject to Part 382, that employer arranges the appropriate return-to-duty test after the SAP compliance finding and remains responsible for the work decision. If the driver has no current or prospective Part 382 employer, FMCSA allows the driver to register in the Clearinghouse as an owner-operator and designate a C/TPA for the limited purpose of completing the RTD process. Once designated, the C/TPA can direct the RTD test and report the negative result to the Clearinghouse. The SAP’s follow-up testing plan must then be administered by the driver’s employer when the driver resumes work in a DOT safety-sensitive position. Illustrative case: the driver returns after leaving early

A driver leaves a random collection before completion, then comes back later and offers to test. The employer must assess the original conduct under the refusal rule. A later negative specimen is not an automatic cure. If the refusal stands, the SAP process is still required before a qualifying return.
