Who needs a Clearinghouse query policy?

Every employer of CDL or CLP drivers who perform safety-sensitive functions must run queries against the Clearinghouse: a full pre-employment query before a new driver first performs safety-sensitive work, and at least one query on every current driver in each 12-month period. That includes owner-operators under your authority and leased drivers operating at your direction. A written policy assigns the responsibilities, deadlines and consent steps so queries do not silently lapse between hires.

Limited query or full query: what is the difference?

A limited query tells you only whether the Clearinghouse holds any information about a driver. It satisfies the annual query requirement and runs on employer-held consent, which can cover multiple years if the consent document says so. A full query returns the driver’s detailed record and requires the driver’s electronic consent inside the Clearinghouse. The trap sits between the two: if a limited query shows a record exists, you must complete a full query within 24 hours or pull the driver from safety-sensitive functions until you do.
