For a Brooklyn employer with drivers subject to FMCSA drug and alcohol testing rules, Clearinghouse compliance starts before a CDL driver performs safety-sensitive work and continues for as long as that driver is employed. Employers must complete the required pre-employment query, conduct a query at least annually, and report the violations and return-to-duty information assigned to employers under Part 382. DOT Compliance Companies lists providers that cover Brooklyn and offer Clearinghouse support.

Private fleets and passenger operators

Our carrier directory lists about 6,430 carrier records with a Brooklyn address, including about 3,920 private carriers and about 2,790 for-hire carriers. Many local operations are contractors, suppliers, distributors and other businesses running trucks as part of a wider operation rather than as their main service.

Part 382 applies to covered CDL drivers operating CMVs on public roads in interstate or intrastate commerce. FMCSA specifically includes intrastate motor carriers within its drug and alcohol testing program. Most Brooklyn records in our directory are intrastate-only, so staying within New York does not by itself remove the requirement.

About 310 Brooklyn records list passenger vehicles. Passenger operations whose drivers are subject to FMCSA Part 382 also have Clearinghouse obligations. Drivers whose safety-sensitive work is regulated solely under FTA Part 655 are treated differently, so passenger operators should confirm which DOT testing rules apply to their drivers.

Before a new driver takes the wheel

About 880 Brooklyn records first registered with FMCSA in 2025 or later. Before hiring a driver to perform safety-sensitive functions covered by Part 382, the employer must conduct a full pre-employment Clearinghouse query. The driver gives specific electronic consent through the Clearinghouse. The employer must confirm that the driver is not prohibited before allowing covered safety-sensitive work.

If a driver is in prohibited status, the driver cannot perform safety-sensitive functions until the required return-to-duty steps have been completed through a Substance Abuse Professional and the driver has obtained the required negative return-to-duty test result. Running the annual cycle

  • Conduct a Clearinghouse query for every covered CDL driver at least once within each 12-month period.
  • A limited query can satisfy the annual requirement with the driver’s general consent. If it shows that information exists, obtain electronic consent and conduct the required full query.
  • Maintain an appropriate Clearinghouse query plan, or designate a C/TPA to conduct queries on the employer’s behalf.
  • Report employer-reportable information, including applicable refusals, actual knowledge violations, negative return-to-duty test results and completion of follow-up testing.
  • Keep the driver’s limited-query consent for three years. Query history itself is maintained in the Clearinghouse.

About 3,550 Brooklyn records list one power unit. An owner-operator who employs himself or herself as a CDL driver must designate a C/TPA in the Clearinghouse for the reporting functions assigned to the C/TPA. This is commonly handled alongside drug testing consortium membership in New York.

Questions for a Brooklyn provider

Ask whether the provider can act as your designated C/TPA, who tracks annual query due dates, which Clearinghouse reports they submit on your behalf, and what remains the employer’s responsibility.

New York Highway Use Tax is separate from Clearinghouse compliance. Certain vehicles operating on New York public highways are subject to HUT registration, mileage recordkeeping and tax requirements administered by the New York State Department of Taxation and Finance. Do not treat HUT compliance as part of the federal Clearinghouse process.

DOT compliance questions for Brooklyn

Our drivers only work inside New York City. Do we still need Clearinghouse queries?

Intrastate operation does not by itself create an exemption. If the drivers are subject to FMCSA Part 382, the employer must meet the applicable Clearinghouse requirements.

Do bus companies in Brooklyn have Clearinghouse duties?

Passenger operations with drivers subject to FMCSA Part 382 do. Drivers regulated solely under FTA Part 655 are outside Part 382, so the applicable DOT testing program should be confirmed.

I drive my own truck. Who runs my queries?

An owner-operator who employs himself or herself as a CDL driver must designate a C/TPA in the Clearinghouse. The owner-operator remains responsible for meeting the applicable employer and driver requirements.

Are listed providers based in Brooklyn?

Providers may serve Brooklyn remotely or in person. Confirm whether you need local onsite support before choosing one. Most Clearinghouse work can be handled remotely.

How long must I keep query records?

The Clearinghouse maintains query history. Employers must keep a driver's limited-query consent for three years.
