• Do not allow the driver to perform safety-sensitive functions until the required query is complete and the driver is not prohibited.

Clearinghouse compliance can be reviewed during a New Entrant Safety Audit or other FMCSA compliance activity, along with the carrier’s drug and alcohol testing program.

For-hire fleets and driver turnover

About 7,810 Nevada records are for-hire carriers. Fleets adding or replacing CDL drivers need a new full pre-employment query for each covered hire. Current drivers must be queried at least once during each rolling 12-month period.

A limited query can satisfy the annual requirement when the employer has the required general consent. If a limited query shows that information exists in the driver’s record, the employer must obtain a full query within 24 hours. If that full query is not completed within the required period, the driver cannot continue performing safety-sensitive functions until the employer obtains the result and confirms the driver is not prohibited.

If a query shows prohibited status, the driver must be removed from safety-sensitive functions. Returning to covered work requires completion of the applicable return-to-duty process, including the SAP process and a negative directly observed return-to-duty test.

Owner-operators across the state

About 5,470 Nevada records list a single power unit. An owner-operator who employs himself or herself as a CDL driver must designate a C/TPA in the Clearinghouse for required reporting functions. The owner-operator must also meet the applicable random drug and alcohol testing requirements, commonly through a consortium random testing pool.
