Stockton employers with drivers subject to Part 382 need Clearinghouse procedures that work before the first dispatch: pre-employment queries, annual queries, required violation reporting and proper consent records. A designated C/TPA can perform specific Clearinghouse functions for an employer, including queries and reporting when authorized.

Owner-drivers and small fleets in Stockton
Our carrier directory lists about 4,180 carriers with a Stockton address, and about 2,570 of those records show one power unit. For an owner-operator who employs themselves as a CDL driver, Clearinghouse registration is not enough by itself. The owner-operator must designate a C/TPA for the employer reporting responsibilities required by the Clearinghouse.
About 2,760 Stockton records are intrastate-only. Intrastate operation does not by itself create an exemption. FMCSA’s Clearinghouse requirements cover drivers subject to the CDL drug and alcohol testing rules, including covered intrastate operations.
Queries and reporting an employer needs to control
- Complete a full pre-employment query before a prospective CDL driver performs safety-sensitive work. The driver provides specific electronic consent through the Clearinghouse.
- Conduct at least one Clearinghouse query for each covered driver within every 12-month period.
- A limited annual query may be used with the driver’s general consent.
- If a limited query indicates that information exists, complete the required full query within 24 hours. If it is not completed, remove the driver from safety-sensitive functions until the full query is obtained.
- Report employer-reportable violations required by Part 382, including specified refusals and actual-knowledge violations.
The Clearinghouse maintains the employer’s query history. Employers are not generally required to print and retain every query result separately, although limited-query consent must be kept for three years. A designated C/TPA can conduct queries and make authorized reports, but the employer remains responsible for compliance. The full rule text is in 49 CFR Part 382).
When a driver is in prohibited status
A driver in prohibited status cannot perform safety-sensitive functions. To become eligible for return-to-duty testing, the driver must complete the SAP process, including the initial evaluation, any required education or treatment and the SAP’s follow-up evaluation. The return-to-duty test must be directly observed.
After a negative return-to-duty result is reported, the driver’s Clearinghouse status can change to not prohibited and the driver may return to safety-sensitive work. The SAP’s required follow-up testing plan continues after that return. Compare SAP evaluations in California or read about the DOT SAP program for US drivers.
Getting set up with a Stockton-area provider
Ask exactly what the provider will do as your C/TPA: conduct queries, make employer reports, track annual query dates, manage testing or some combination of those services. If you also need a random testing program, compare a drug testing consortium in California.
About 490 Stockton carrier records in the directory show an initial FMCSA registration date in 2025 or later. For a new operation, setting up the Clearinghouse process before adding CDL drivers is simpler than correcting missed queries later. Results reflect providers’ declared coverage for California.

DOT compliance questions for Stockton
How do I designate a C/TPA as an owner-operator?
Register in the Clearinghouse with the appropriate employer role and designate the C/TPA through the account. The C/TPA must be registered before it can perform designated functions for you.
Can we use a limited query at hire?
No. The pre-employment requirement is a full query with the driver's specific electronic consent in the Clearinghouse.
How long does a driver stay in prohibited status?
The driver remains prohibited until the required return-to-duty steps have been completed and a negative directly observed return-to-duty test has been reported. Follow-up testing continues after the driver returns to safety-sensitive work.
Can Stockton-area providers help with testing too?
Some C/TPAs also manage random testing programs or coordinate collections. Confirm exactly which services are included and whether suitable collection sites are available for your drivers.
