If the full query is not completed within that period, the driver cannot continue performing safety-sensitive functions until it is completed.

The Clearinghouse retains the employer’s query history, so separate copies of every query result are not generally required. Employers must retain a driver’s limited-query consent for three years.

If a driver is in prohibited status, the driver cannot perform safety-sensitive functions. The return-to-duty process includes a SAP evaluation, any required education or treatment, a SAP follow-up evaluation and a directly observed return-to-duty test. Once the required steps have been completed and a negative return-to-duty test is reported, the driver’s status can return to not prohibited.
