Before a new CDL driver performs a safety-sensitive function for a Part 382 employer, the employer must complete a full Clearinghouse query. The driver provides specific electronic consent through the Clearinghouse before the detailed record can be released. That requirement applies even when the driver recently worked for another motor carrier.

Oilfield customers and contractors may impose their own testing, site-access or badging requirements. Those programs do not automatically satisfy the motor carrier’s Part 382 obligations. Keep DOT testing and Clearinghouse compliance clearly identified so you can show which records satisfy the federal program.

Odessa has a large number of one-power-unit carrier records. An owner-operator who employs himself or herself as a CDL driver is subject to Clearinghouse requirements as both an employer and a driver and must designate a C/TPA in the Clearinghouse.

The employer must purchase its own Clearinghouse query plan. A designated C/TPA may conduct queries for the owner-operator, but the C/TPA cannot purchase the employer’s query plan.

Annual queries, reporting and prohibited drivers

Each covered CDL driver must be queried at least once during every 12-month period. A limited query can satisfy the annual requirement when the employer has the required general consent. If the limited query indicates that information exists, a full query must follow within 24 hours. If that full query is not completed in time, the driver cannot continue performing safety-sensitive functions until the query is completed and the result allows it.

Employers also have reporting obligations for specified Part 382 violations. A driver in prohibited status cannot perform safety-sensitive functions until the applicable return-to-duty requirements are met. The process includes a SAP evaluation, required education or treatment, a follow-up SAP evaluation and a negative directly observed return-to-duty test. Drivers can start with SAP evaluations in Texas or the national DOT SAP program.

What to ask an Odessa provider

Ask whether the provider will act as your designated C/TPA, which Clearinghouse functions it will perform, and how annual query dates are tracked. If you hire drivers on short notice, ask how the provider handles registration or consent problems that prevent a full query from being completed.
