Where Part 382 applies, five alcohol and drug violations trigger automatic failure. Other listed violations include knowingly using drivers without a valid CDL or while disqualified; knowingly using a physically unqualified driver; operating without required financial responsibility; failing to require duty-status records; operating a vehicle before an out-of-service condition is repaired; failing to correct an out-of-service DVIR defect before operation; and using vehicles without the required periodic inspection.

New entrants are monitored throughout the 18-month period. 49 CFR 385.308 allows an expedited audit, compliance review or corrective-action demand after specified events.

Preparing California carrier audit records

When preparing a California carrier, match the engagement to the actual audit notice and operating history. Records from another terminal or state may still form part of the carrier’s evidence. Confirm who in the California operation will answer the auditor and implement any necessary corrections.

Have the audit correspondence ready, driver and vehicle lists, qualification files, hours records, maintenance evidence and applicable testing records for secure review.
