After a worker violates a Department of Transportation drug or alcohol rule, the employer must immediately remove that person from safety-sensitive duties. A DOT SAP evaluation is the first clinical step in the return-to-duty process that follows. It is not a quick certificate, a drug test or a promise that a driver will return to work. A qualified Substance Abuse Professional independently evaluates the employee, recommends education or treatment, conducts the follow-up evaluation and sends the required reports directly to the employer’s designated representative.

Use the right service: DOT-regulated employees need a SAP who meets every qualification in 49 CFR 40.281. A general counselor, treatment center or online completion letter is not enough.

Who needs a DOT SAP evaluation?

The Part 40 process applies after a verified positive DOT drug test, an alcohol result of 0.04 or greater, a refusal to test or another violation under the applicable DOT agency rule. The employee must be removed from safety-sensitive functions immediately and cannot perform those duties for any DOT-regulated employer until the required return-to-duty process is completed.

The employer must also give the employee information about qualified SAPs as required by Part 40, even when the person is an applicant or is no longer employed. For FMCSA-regulated CDL drivers, the violation and process also interact with the Drug and Alcohol Clearinghouse. The driver designates the chosen SAP in the Clearinghouse, the SAP reports the required initial-evaluation and successful-compliance milestones, and the employer or its designated C/TPA reports a qualifying return-to-duty test result. The evaluation does not erase a record.

How to verify a qualified SAP

Part 40 requires an eligible professional credential, qualification training, a passed examination and continuing education. The credential must also permit the professional to practice where the evaluation occurs. This matters for remote sessions because professional licensing rules can depend on the driver’s location at the time of the appointment.

  • Ask which Part 40 eligible credential the SAP holds and which authority issued it.
  • Confirm that SAP qualification training, examination and continuing education are current.
  • For video appointments, confirm the SAP can lawfully serve the state where the employee will sit.
  • Make sure the session uses real-time two-way audio and video with appropriate confidentiality.
  • Ask how the SAP sends initial and follow-up reports securely to the DER.
  • Confirm whether the provider handles FMCSA Clearinghouse SAP reporting when it applies.

What a legitimate provider will never promise

A SAP cannot guarantee a same-day completion, a particular recommendation, a negative return-to-duty test, Clearinghouse removal or a job. The employee cannot shop for a second SAP simply because the first recommendation is inconvenient. The professional must protect public safety and exercise independent clinical judgment.

Red flags: instant certificates, an evaluation conducted only by form or text message, a provider unwilling to identify its credential, promises of the “shortest program,” no employer report process, or instructions for the driver to order a personal return-to-duty test.

Remote and in-person SAP appointments

DOT permits the clinical interaction to occur in person or through compliant real-time video. Remote service can improve access for drivers away from home, but it does not reduce the required assessment. The connection must let the SAP see and hear what would be available in a face-to-face meeting and must protect confidentiality to an appropriate professional standard.

Ask where the SAP and employee may be located, what happens if the video fails, how identity is verified, and whether a private room is required. A telephone-only call is not the remote evaluation described by Part 40.

Employer and driver responsibilities stay separate

The SAP alone determines the assistance needed, whether successful compliance has been demonstrated and the follow-up testing plan. Scheduling, payment support or administrative coordination cannot be used to influence or replace those clinical and regulatory judgments. The employer decides whether to employ or return the person to a safety-sensitive role. If it chooses to proceed, the employer must order the correct return-to-duty test and receive the qualifying result before covered work begins. For FMCSA drivers, each party must complete its own required Clearinghouse report.
