Return-to-duty process

A failed or refused DOT drug or alcohol test does not end a driving career, but it does start a fixed federal process. Track exactly where you are in the six steps of 49 CFR Part 40 Subpart O and see what has to happen next.

Employers and MROs must report violations. Drivers can check their own record in the Clearinghouse.

The six steps, in order

1. Immediate removal

The driver stops all safety-sensitive functions straight away. The employer reports the violation to the Clearinghouse and gives the driver a list of qualified SAPs at no cost.

2. SAP evaluation

A qualified Substance Abuse Professional assesses the driver face to face and decides what education, treatment or both is required.

3. Education or treatment

The driver completes exactly what the SAP prescribed. The SAP, not the employer and not the driver, sets the programme.

4. Follow-up evaluation

The SAP re-evaluates, confirms compliance, releases the driver for testing and writes the follow-up testing plan.

5. Return-to-duty test

A directly observed test, arranged by an employer, with a negative result before any safety-sensitive work restarts.

6. Follow-up testing

At least 6 unannounced tests in the first 12 months back, and the SAP can extend follow-up testing for up to 60 months.

Points that catch people out

You choose the SAP

The employer must supply a list at no cost, but the driver is free to use any qualified SAP. The driver normally pays for the SAP process unless policy or agreement says otherwise.

The Clearinghouse follows you

The violation stays visible to prospective DOT employers until the return-to-duty process is complete and follow-up testing is finished, so the record is cleared by finishing the process, not by waiting.

The employer does not have to rehire

Federal rules set out how a driver becomes eligible again. They do not require the original employer to give the job back.

A second violation restarts it

Any later violation begins the whole process again and the follow-up plan can be considerably longer.

What happens if you fail a DOT drug test?

The driver is immediately removed from all safety-sensitive functions, the violation is reported to the FMCSA Drug and Alcohol Clearinghouse, and the driver cannot return to safety-sensitive work until the full return-to-duty process under 49 CFR Part 40 Subpart O is completed. The employer must give the driver a list of Substance Abuse Professionals.

What is a SAP and what do they do?

A Substance Abuse Professional is a qualified counsellor, therapist or physician who evaluates a driver after a DOT drug or alcohol violation, prescribes education or treatment, re-evaluates the driver to confirm compliance, and sets the follow-up testing plan. The SAP works to DOT rules and cannot be the same person who provides the treatment they prescribed in most circumstances.

How long does the SAP process take?

There is no fixed federal timescale. It depends on how quickly the initial evaluation is booked, the length of the education or treatment the SAP prescribes, and how soon the follow-up evaluation and a negative return-to-duty test can be completed. Simple cases can take a few weeks and treatment-heavy cases considerably longer.

How many follow-up tests are required after a failed DOT drug test?

The SAP sets the plan, which must include at least 6 unannounced follow-up tests in the first 12 months after the driver returns to safety-sensitive duty. The SAP may extend follow-up testing for up to 60 months in total.

Can you drive a truck after failing a drug test?

Not until the return-to-duty process is finished. The driver must complete the SAP evaluation and prescribed programme, be released by the SAP, pass a directly observed return-to-duty test, and have the Clearinghouse record updated before performing any safety-sensitive function for any DOT employer.

Do I have to use the SAP my employer names?

No. The employer must provide a list of qualified SAPs at no cost to the driver, but the driver may choose any qualified SAP. The driver normally pays for the SAP process unless a company policy or collective agreement says otherwise.
