Private fleets and intrastate employers

Owner-operators and the annual query
About 24,470 Kentucky records list a single power unit. An owner-operator who employs himself or herself as a CDL driver must designate a C/TPA in the Clearinghouse. The C/TPA is required for the owner-operator’s employer reporting obligations and may also conduct queries when properly designated.
For current drivers, a limited query can satisfy the annual requirement when the employer has the required general consent. If the limited query shows that information exists, a full query must be completed within 24 hours. If that does not happen, the driver cannot continue performing safety-sensitive functions until the full query is completed and the result permits it.
Employers purchase their own Clearinghouse query plan. A C/TPA can conduct the query for a client but cannot purchase the employer’s query plan on the employer’s behalf.
A driver with prohibited status cannot perform safety-sensitive functions. To become eligible to return, the driver must complete the required SAP evaluation and education or treatment steps and obtain a negative, directly observed return-to-duty test. Any prescribed follow-up testing obligations continue afterward.
