SAP Evaluation Cost: What the DOT SAP Program Costs

A DOT SAP evaluation is only one potential cost in the return-to-duty process. There is an initial SAP evaluation, any education or treatment the SAP requires, a follow-up evaluation, a return-to-duty test and, after a return to safety-sensitive work, the SAP’s follow-up testing plan. DOT regulations do not set SAP prices, so the useful number is not just the first quoted fee. Before paying, find out exactly what the SAP fee includes and which costs will be billed separately.

What the total is made of

  • Initial SAP evaluation: the clinical assessment where the SAP determines what education, treatment or both is appropriate. The SAP may conduct it face-to-face in person or by a qualifying real-time audio and video evaluation permitted under Part 40.
  • Follow-up evaluation: after the recommended education or treatment, the SAP evaluates whether you have demonstrated successful compliance. Some providers include this in the original fee and others bill separately.
  • Education or treatment: normally provided and billed separately by the program or professional to which the SAP refers you. The cost depends on what the SAP determines is appropriate.
  • Return-to-duty test: after the SAP determines that you have successfully complied, an employer must arrange the required drug test, alcohol test or both before you can resume DOT safety-sensitive duties. A return-to-duty drug test is conducted under direct observation.
  • Follow-up tests: the SAP must prescribe at least six unannounced tests during the first 12 months of safety-sensitive duty after you return. The SAP can require additional testing during the following 48 months of safety-sensitive duty.
  • Clearinghouse: FMCSA does not charge a driver a fee to register or designate a SAP. For an FMCSA-covered driver, the SAP must be registered in the Clearinghouse to accept the driver’s designation and report the required return-to-duty information.
  • Other provider charges: ask about missed appointments, rescheduling, document requests, translation and any other administrative charges before paying.

Who pays for each part

Part 40 does not require the employer to pay for a SAP evaluation, recommended education or treatment. Payment for SAP services is left to the employer and employee and can also be affected by a labor agreement or health benefits. The employer must provide a driver who has a DOT violation with a list of qualified SAPs that are readily available and acceptable to the employer, and cannot charge the driver for providing that list.

The employer is responsible for ensuring that the required return-to-duty test occurs before allowing a driver back into safety-sensitive work and for carrying out the SAP’s follow-up testing requirements. What pushes the price up or down

  • The SAP’s recommendation: education and a more substantial treatment program can produce very different total costs.
  • What the quoted SAP fee includes: check whether the initial evaluation, follow-up evaluation, required reports and Clearinghouse reporting are all included.
  • In-person or remote evaluation: Part 40 permits qualifying remote evaluations using real-time audio and video. The SAP chooses the evaluation method and must also comply with any geographic limits that apply to their professional credential. See online SAP evaluations before choosing a provider.
  • Treatment coverage: some health plans may cover some recommended treatment even when they do not cover the SAP evaluation itself.
  • Follow-up testing: the SAP decides the number and type of follow-up tests, subject to the Part 40 minimum. More required tests can mean more testing costs once you are back in safety-sensitive work.
  • Employer testing arrangements: an employer or C/TPA may already have collection and testing arrangements in place for return-to-duty and follow-up testing.

Red flags when comparing SAPs

  • A guaranteed outcome. A SAP cannot promise a minimal recommendation, guaranteed successful compliance determination or guaranteed return date before properly evaluating you.
  • A “second opinion” offer. Once a qualified SAP has evaluated you, Part 40 does not allow the employee or employer to obtain another SAP evaluation simply to get a different recommendation.
  • A financial interest in the treatment referral. Part 40 generally prohibits a SAP from referring you to the SAP’s own private practice or to a provider from which the SAP receives payment or has a financial interest. The regulation contains specific exceptions, including certain public, employer-contracted and sole-source treatment arrangements.
  • A questionnaire-only or telephone-only evaluation. A remote SAP evaluation must provide real-time audio and visual interaction that meets Part 40 requirements.
  • A person who cannot show that they meet DOT SAP qualification requirements. For an FMCSA Clearinghouse case, also confirm that the SAP is registered in the Clearinghouse so you can designate them and they can make the required entries.

Questions to get a written quote

  • Does your fee include both the initial evaluation and the follow-up evaluation?
  • What other SAP or administrative charges could I be billed?
  • Is education or treatment billed by a separate provider?
  • Who is responsible for the cost of the return-to-duty and follow-up tests?
  • Are you DOT-qualified under Part 40?
  • If this is an FMCSA Clearinghouse case, are you registered in the Clearinghouse?
  • After my initial assessment and successful compliance determination, will you make the required Clearinghouse entries within the required reporting timeframe?
  • Do you conduct evaluations in person or remotely, and if remotely, does the evaluation use real-time audio and video as required by Part 40?

How much does a SAP evaluation cost?

DOT regulations do not set a price. The amount depends on the provider and what the quoted fee includes. Ask whether the initial evaluation, follow-up evaluation, reports and any administrative charges are included before comparing prices.

Is the SAP evaluation fee the whole cost of the SAP process?

Not necessarily. Recommended education or treatment may be billed separately. There can also be costs associated with the return-to-duty test and the follow-up testing required after returning to safety-sensitive work.

Does insurance cover the DOT SAP program?
