The Clearinghouse applies to employers and drivers covered by FMCSA’s DOT drug and alcohol testing rules. In practice, that usually means interstate or intrastate motor carriers using drivers who must hold a commercial driver’s license or commercial learner’s permit to perform safety-sensitive work. It also includes owner-operators operating under their own authority, because they are treated as employers for Clearinghouse and testing-program purposes.

Clearinghouse status now reaches beyond the employer file. FMCSA’s CDL Downgrades FAQ states that, as of November 18, 2024, State Driver Licensing Agencies must remove commercial driving privileges from an individual who is subject to the CMV driving prohibition. In plain terms, a prohibited driver loses or may be denied commercial driving privileges. After the return-to-duty process produces a not-prohibited Clearinghouse status, the applicable State Driver Licensing Agency handles CDL or CLP reinstatement.

Clearinghouse duties are federal and most administration can be handled online for an employer in Ohio. If a driver’s CDL or CLP is affected, the relevant licensing agency may be Ohio’s or another state’s, depending on where the license was issued; provider location does not decide reinstatement.

Securely prepare the Part 382 roster (including CDL and CLP holders), query deadlines and details of incomplete consent or reporting tasks. Use the proper query and consent route; provider assistance cannot bypass a prohibited status or remove a valid violation.
