Omaha employers that use CDL drivers subject to Part 382 need Clearinghouse procedures built into hiring and ongoing driver management. That includes a full pre-employment query when required, a query at least once every 12 months for each current covered driver, required reporting, and immediate action when a query shows a driver is prohibited. A designated consortium/third-party administrator (C/TPA) can perform many of those Clearinghouse functions for the employer.

Clearinghouse controls in private fleets

Our carrier directory lists about 3,970 carrier records with an Omaha address. About 2,660 are marked as private carriers and about 1,580 as for-hire. Private fleets can include contractors, distributors, manufacturers, building-material suppliers, waste operations and other businesses where transportation supports the main operation.

That structure can create a simple compliance problem: recruiting and payroll may sit with HR, while CDL qualification and Part 382 responsibilities sit with operations or safety. A good program assigns responsibility clearly so a new covered driver is not released into safety-sensitive work before the required steps are complete and annual queries are not missed when staff responsibilities change.

About 1,960 Omaha records show a single power unit. An owner-operator who employs himself or herself as a CDL driver must designate a C/TPA in the Clearinghouse. A one-driver operation not leased to another motor carrier also needs a qualifying consortium arrangement for random testing.

What Omaha employers should have in place

  • Register the employer in the Clearinghouse and purchase the employer’s query plan, even when a C/TPA will conduct queries
  • Complete the required full pre-employment query with the driver’s specific electronic consent before hiring the driver to perform safety-sensitive functions
  • Conduct a query at least once every 12 months for each current covered CDL driver
  • Use a limited query for the annual requirement if appropriate and supported by general consent; if the limited query shows information exists, obtain electronic consent and complete the required full query within 24 hours
  • Report employer-reportable violations, including applicable refusals and actual knowledge under Part 382
  • Retain general consent for limited queries for three years; the Clearinghouse maintains the query history

The Clearinghouse is national. A driver’s record is not limited to Nebraska, so reportable information entered in connection with employment elsewhere can appear when an Omaha employer conducts a query.

If a driver is prohibited

A driver shown as prohibited cannot perform safety-sensitive functions for the employer. The return-to-duty process involves an evaluation by a qualified SAP, completion of the SAP’s education or treatment requirements, a follow-up SAP evaluation and a negative directly observed return-to-duty test before the driver can return to covered safety-sensitive work. A prescribed follow-up testing plan continues after the return-to-duty test. The DOT SAP program nationally covers that process in more detail.

Employers should have a clear internal procedure for who receives Clearinghouse results, who removes a prohibited driver from safety-sensitive work and who coordinates any return-to-duty documentation.

Finding help in Omaha

Ask whether the provider can act as your designated C/TPA, whether random-testing consortium service is included if required, how annual query dates are monitored and where collection sites are available for Omaha-area drivers. If you recruit drivers from Council Bluffs or elsewhere outside Nebraska, the same federal Clearinghouse query process applies.

DOT compliance questions for Omaha

Our HR team handles hiring. What do they need to know?

HR and the person responsible for DOT compliance need a defined handoff. A covered CDL driver cannot be hired to perform safety-sensitive functions until the required full pre-employment Clearinghouse query has been completed.

Can a provider run queries for us?

Yes. A C/TPA designated in the Clearinghouse can conduct queries on the employer's behalf. The employer remains responsible for compliance and must purchase its own query plan.

Does the provider need to be located in Omaha?

No. Clearinghouse queries are conducted online. For services involving specimen collections or onsite assistance, confirm the provider's actual Omaha-area coverage.

How long must we keep query records?

The Clearinghouse maintains the employer's query history. The employer must retain a driver's general consent for limited queries for three years.
