Maryland carriers recruit drivers in a market that extends into DC, Virginia, Pennsylvania and Delaware. Construction contractors, waste fleets, port operations and regional carriers may all draw from the same driver pool. When you hire a driver for a position subject to Part 382, a new pre-employment query is required even if that driver was recently working for another carrier.
The Clearinghouse is a national FMCSA database. A reportable Part 382 violation that occurred while a driver was working for an FMCSA-regulated employer on or after January 6, 2020 can appear when a Maryland employer conducts a query, regardless of the state where the violation occurred.
The site’s FMCSA-based carrier data includes about 44,250 Maryland carrier records. About 5,660 first registered with FMCSA in 2025 or later, and about 24,030 show one power unit. For an owner-operator who employs himself or herself as a CDL driver, Clearinghouse compliance has an additional step: the owner-operator must designate a C/TPA for required reporting functions.
The queries Maryland employers must run
- Run a full pre-employment query, with the driver’s electronic consent in the Clearinghouse, before the driver first performs safety-sensitive functions for you
- Query each current driver at least once every 12 months
- A limited query may be used for the annual check with the driver’s general consent
- If a limited query returns “Record(s) Found; Full Query Needed,” complete the full query within 24 hours or remove the driver from safety-sensitive functions until it is completed
- Purchase an appropriate query plan and make sure anyone conducting queries on your behalf is properly designated
The Clearinghouse maintains the employer’s query history, including queries conducted by a designated C/TPA. Employers do not need to keep separate copies of each Clearinghouse query solely to satisfy the query-record retention requirement, but general consent used for limited queries must be retained for three years.
Employers also have their own reporting duties, including certain refusals to test and actual-knowledge violations. MROs report verified positive, adulterated or substituted drug test results and certain drug-test refusals. When a query shows a violation
A full query may show that a driver is in prohibited status. A prohibited driver cannot perform safety-sensitive functions until the required return-to-duty process has been completed. That process includes a SAP evaluation, completion of the education or treatment required by the SAP, a follow-up SAP evaluation, and a negative directly observed return-to-duty test. The employer must then carry out the SAP’s prescribed follow-up testing plan after the driver returns to safety-sensitive work.
A provider can help coordinate the employer-side requirements, but the responsibilities of the SAP, testing provider, MRO, employer and C/TPA remain separate under Parts 40 and 382.
Getting set up with a provider
Ask exactly what the provider will handle. Confirm whether they will accept designation as your C/TPA, conduct queries, submit employer-reportable information, manage your random testing program, or provide only advisory support. Do not assume one service automatically includes the others.

Does a driver's violation from another state show up in our query?
It can. The Clearinghouse is national, so reportable FMCSA drug and alcohol violations in the driver's Clearinghouse record are not limited by state. The database covers qualifying violations occurring on or after January 6, 2020.
Can we use a limited query for the annual check?
Yes. You need the driver's general consent. If the limited query returns a record-found result, complete a full query within 24 hours or remove the driver from safety-sensitive functions until the full query is completed. The driver must provide electronic consent for the full query in the Clearinghouse.
What happens if we skip the annual query?

Do we need a provider based in Maryland?
Not for the Clearinghouse itself because queries are conducted online. If the provider is also handling drug and alcohol testing, confirm that collection arrangements work for the locations where your drivers operate.
Can a prohibited driver do non-driving work for us?
Part 382 prohibits the driver from performing safety-sensitive functions while prohibited. Whether a particular non-driving assignment is permissible depends on the duties involved, so classify the work carefully before reassigning the driver.
